RE: Your
letter dated 12-11-2000 Denial of Requested Refusal for Interaction between
State Agencies and Children
As I understand your letter, you will not comply with my
requests that MY children-
- Are
not to be removed from their classrooms by any agent of the government
without a “properly executed search warrant”.
- Not
to be isolated in the presence of, or interrogated by, such agents without
the presence of me, my wife, or a legal representative.
- In
the event that such agents come onto school grounds, with proper
identification, and have legally executed a search warrant, the children are
not to be removed from the classroom for the purpose of questioning or
interrogation prior to notification and the presence of me and/or my wife
and/or a legal representative.
In your 12-11-2000 letter, you have cited ORS
419B.005, ORS 419B.020, and
ORS 419B.045, and your Student Policies Board Policy No. JFG as
your legal reasons for refusing to comply with my request.
I am citing The Constitution of the United States of
America-
- I am
claiming for my children and myself our FOURTH AMENDMENT Constitutional
Right against Unreasonable Search and Seizure of persons or property WITHOUT
A WARRANT.
- I am
claiming for my children and myself our FIFTH AMENDMENT Constitutional Right
not to be compelled to be a witness against ourselves, be deprived of
liberty or property, or have our property TAKEN FOR PUBLIC USE.
- I am
claiming for my children and myself our FOURTEENTH AMENDMENT Constitutional
Right against any state abridging our privileges or immunities, or depriving
us of liberty or property, without due process of law; nor deny to any
person within its jurisdiction the equal protection of the laws.
- Further,
I am reserving MIRANDA RIGHTS for my children and myself.
I am curious if you care to STATE FOR THE RECORD that my
children’s and my Civil Rights guaranteed by the Constitution of the United
States of America and our Miranda Rights are SUPPLANTED, SUPERSEDED or NULLIFIED
by ORS
419B.005, ORS 419B.020, and ORS 419B.045, and your Student Policies Board Policy No. JFG?
